For Islam, marriage is not a sacrament but a contract of a particular type which is agreed between two consenting persons in front of witnesses, and which can be broken or terminated. It is by no means obligatory that this particular contract be concluded in the presence of a theologian or an imam, nor even that it be concluded in a mosque. Marriage is only the externalization of an intention of commitment and the awareness of responsibilities.
It should be remembered that in Islam, no one can force a woman to marry a man if she does not want to. Two cases are reported which show two women coming to complain to the Prophet (peace be upon him) that their father had married them against their will: one of these women had previously had another husband, the other never had never been married before. In both cases the Prophet gave them the choice to annul the marriage.
