Islamic jurisprudence has been made rigid and impotent instead of lively and efficient. There is a gap between the teachings and principles of Islam, and the reality and practices of Muslims on a daily basis. The purposes of the Law and the lessons drawn from it, the causes of each Islamic rule and the purposes of the Legislator have been neglected. Muslim scholars are therefore faced with this question: reorganize priorities, restructure criteria and values in order to achieve an interest in human beings and protect them from harm.
The author of this book presents the approach of a great Andalusian figure, Imam Abou Ishâq ach-Châtibî, one of the greatest renovators of Islam, considered today as an essential reference in the field of superiors of the law of Islam.
The author has done vital and necessary work concerning the rules and principles organizing and defining the higher objectives of the Law of Islam. After having studied in detail the two works of ash-Châtibî Al-mouwâfaqât and Al-itisâm, he extracted from them a precious treasure of rules relating to the higher objectives of the Law and highlighted the main methods allowing them to be identified and to analyze them.
This work is fundamental for the elaboration of a modern reflection on the question of the superior objectives of the Law. The reader will find in the various chapters numerous examples of “living case law” accompanied by rules and criteria.
Applied to the disorders that our contemporary societies know, this work would be a cornerstone for a better architecture of our current world as much on the political, economic, ecological, social or religious level.
