المختصر في الفتوى بمذهب مالك بن انس

المعروف ب " مختصر خليل" للمؤلف: الشيخ ضياء الدين خليل بن إسحاق الجندي، عني به خالد بن عمر بن عمار العلمي الجزائري

مختصر الشيخ خليل بن إسحاق من أكثر المختصرات الفقهية في المذهب المالكي التي حظيت بقبول وشهرة وإنتشار ، وبخاصة في أنحاء المغرب الاسلامي. حتى صار العمدة في بابه ، والمقدم عند طلابه، وغدا أن يحفظه من بين الأقران متفوقا، ومن يضبطه من بين علماء المذهب مرجعا ومحققا. إذ هو عظيم الجدوى، بليغ الفحوى، مبين لم به الفتوى، او ماهو المرجح الأقوى ، قد جمع الاختصار في شدة الضبط والتهذيب ، وأظهر الإقتدار في حسن المساق والترتيب. وقد قيل أن مؤلفة مكث في تأليفه ٢٥ سنة، ولذلك فإنه سلك فيه مسلكا  بديعا، ونحا فيه منحى رفيعا، فإختصر فيه المعنى الكثير في اللفظ الوجيز وإقتصر على ما به الفتوى فأتى بكل عزيز ، ونبه على كثير من مشكلات المدونة وأتى من غرائب النوازل، وطرق الفتاوى بطرق مستحسنة ، مقتصرا في كل ما أورده على القول المشهور وماعليه الفتوى تدور ، وكثر العلم الكثير في الجرم اليسير ليكون على وجه الدهر خزانة للغني والفقير .ولما كان هذا الكتاب بهذه المنزلة،فقد  قام خالد بن عمر بن عمار العلمي الجزائري بإخراجه في حلة تليق به 

"Al-Mukhtasar Fi al-Fatwa Bi Madhhab Mālik ibn Anas," known as the "Summary of Khalil," authored by Sheikh Diaa Al-Din Khalil ibn Ishaq Al-Jundi, is one of the most important legal works in the jurisprudence of Malik Ibn Anas. It has gained significant renown and widespread acceptance, especially in the regions of the Islamic Maghreb. It has become a major reference for students of jurisprudence, a source of teaching, and a preferred text for those seeking expertise in Maliki jurisprudence. This book is extremely valuable as it combines both conciseness and precision in expression, along with a methodical organization of information.

It is said that the author dedicated approximately 25 years to writing this book. He followed an innovative approach, simplifying concepts while retaining the substance of jurisprudence. He addressed many complex aspects of jurisprudence, solving unusual problems and presenting fatwas optimally. He selected the most accepted legal opinions and made a significant contribution to the study of the subject. His work has become an invaluable source of knowledge for both the rich and the poor, ensuring its legacy through generations.

Due to the unquestionable importance of this book, Khalid ibn Omar ibn Ammar Al-Alami from Algeria edited and presented it in a manner befitting its status.

Brief biography of Sheikh Khalil ibn Ishaq:

Khalil ibn Ishaq ibn Moussa ibn Shuaib Al-Jundi was of Kurdish origin, born and died in Egypt. He was a scholar of the Maliki school, specializing in jurisprudence, linguistics, and hadith. He was raised in an environment steeped in knowledge and virtue. From a young age, he was immersed in learning and was recognized for his dedication, devotion, and seriousness in acquiring knowledge. He studied Maliki jurisprudence, the Arabic language, and hadith with various scholars.

In the early 8th century of the Hijri calendar, Sheikh Khalil participated in the jihad to liberate Alexandria and continued to wear the military uniform until his death. He also taught at the Sheikhounia school, where he was known for his teaching of fiqh, linguistics, and hadith. He had a significant influence on the training of scholars and students.

Sheikh Khalil wrote numerous works, including commentaries on grammar, jurisprudence, and hadith works. He also made important contributions in various fields of knowledge. He is best known for his famous "Summary in Jurisprudence according to the Madhhab of Malik," which has become a major reference in Islamic schools.

Sheikh Khalil ibn Ishaq passed away in the month of Rabia Al-Awwal in the year 776 of the Hijri calendar. His funeral was attended by a large number of people, a testament to the esteem and affection he had earned due to his great intellectual and religious stature.
