Husband & wife rights and duties, by Sheikh Mohamed Ali Ferkous (Professor at the Faculty of Islamic Sciences University of Algiers (I)
Original title in Arabic: المعين في بيان حقوق الزوجين
Allah has established the duties that each of the spouses must observe towards the other. One's right is another's duty. The Messenger صلَّى الله عليه وسلَّم said: “Surely you have rights towards your wives, and your wives have rights towards you. » (1)
However, the man - for special considerations - has a precedence that Allah تعالى granted him according to the following verse:
وَلَهُنَّ مِثْلُ الَّذِي عَلَيْهِنَّ بِالْمَعْرُوفِ وَلِلرِّجَا لِ عَلَيْهِنَّ دَرَجَةٌ [ البقرة : 228] .
Meaning of the verse:
"As for them, they have rights equivalent to their obligations, in accordance with propriety. But men nevertheless have a predominance over them. " [s. Al-Baqara (The Cow): 228] .
Conjugal rights are of three kinds: rights common to both of them and rights specific to each, that is to say the rights of the woman towards her husband and the rights of the husband towards her.
In this book, I will deal with the obligations and good morals that Allah has commanded a woman to observe towards her husband. Then, I will discuss the rights of the wife over her husband, as well as the obligations and good morals that Allah عزَّ وجلَّ imposed on the husband to observe towards his wife. Finally I will consider the rights common to both spouses, which are by the Legislator the results resulting from the authenticity of the marriage contract.
